1. WHO WE ARE
This website is operated by Ge:Skenk Corporate Gifts (Pty) Ltd, trading as Geskenk, referred to in these Terms as Geskenk, we, us or our.
Geskenk is based in South Africa. These Terms are governed by South African law, including the Consumer Protection Act 68 of 2008, or CPA, the Electronic Communications and Transactions Act 25 of 2002, or ECTA, and the Protection of Personal Information Act 4 of 2013, or POPIA, where applicable.

2. ACCEPTANCE AND ELECTRONIC COMMUNICATIONS
By using this website, creating an account, submitting an order or accepting a quotation, you agree to these Terms. If you do not agree, please do not use the website or place an order.
You agree that we may communicate with you electronically, including by email, website notice, SMS or WhatsApp where you have supplied or authorised that contact method. Electronic records, order confirmations and communications may be used as evidence of the transaction, subject to applicable law.
3. WEBSITE INFORMATION AND AVAILABILITY
We take reasonable care to keep product descriptions, images, prices and availability accurate. Product images are illustrative and handmade, locally sourced or seasonal items may vary slightly in colour, finish, packaging or availability. We will not substitute a materially different item without contacting you where reasonably possible.
Information on the website may occasionally contain an obvious error, omission or incorrect price. We may correct the error before accepting an order. If the error affects an accepted order, we will contact you promptly and offer an appropriate remedy, including cancellation and a full refund where applicable.
We may update, suspend or change parts of the website for operational, security or maintenance reasons. Nothing in this clause limits any right you have under applicable consumer law.
4. PRODUCTS, PRICES AND AVAILABILITY
Prices are shown in South African Rand, or ZAR. Unless clearly stated otherwise at checkout, prices include VAT where VAT is applicable and exclude delivery charges. The delivery charge, payment method and total payable will be shown before you place your order.
Products are subject to availability. Adding an item to a cart does not reserve it. We may limit quantities where reasonably necessary, including where stock is limited, an item is made to order, or an order appears fraudulent or commercially unreasonable.
Promotional offers apply only for the stated period, are subject to availability and may not be combined unless we say otherwise.
5. ORDERS AND FORMATION OF THE CONTRACT
When you submit an order, you make an offer to buy the relevant products. The automated order acknowledgement confirms that we have received the order. It is not acceptance of the order.
A binding contract is formed when we confirm acceptance of your order in writing, dispatch the goods, or otherwise clearly confirm that the order will be fulfilled. We may decline an order before acceptance for a legitimate reason, including unavailability, an obvious pricing error, inability to verify payment or suspected fraud. If payment has already been taken for an order we cannot accept, we will refund the amount paid promptly.
Please check your order confirmation carefully and tell us as soon as possible if any recipient, address, product or contact detail is incorrect. Changes cannot be guaranteed once an order has entered production or dispatch.
6. PAYMENT
Payment options available at checkout will be displayed before you place your order. Card payments are processed by a secure third-party payment gateway. Geskenk does not store full card details submitted through that gateway.
You confirm that you are authorised to use the selected payment method and that the information you provide is accurate. We may delay fulfilment until payment has been authorised or cleared.
7. DELIVERY
We deliver within South Africa unless we agree otherwise in writing. Delivery times shown on the website or communicated by us are estimates, except where a specific date has been expressly agreed.
You are responsible for providing a complete and accurate delivery address, recipient contact number and any access instructions needed for delivery. If a delivery fails because these details are incorrect, incomplete or unavailable, we will work with you to arrange redelivery where possible. Additional delivery costs may be payable if they arise from the incorrect or incomplete details.
Risk in the goods passes to you or the recipient on delivery. Ownership passes only once we have received payment in full. This does not affect any statutory rights you may have if goods are damaged, defective or not supplied as agreed.
8. CANCELLATIONS, RETURNS AND REFUNDS
You may ask to cancel an order before it enters production or is dispatched. We will confirm whether cancellation is still possible and any amount refundable. Made-to-order, personalised, branded, perishable or specially sourced products may not be cancellable once work or procurement has begun, except where the law provides otherwise.
We do not offer a general return or refund for a change of mind after delivery. This does not limit any cooling-off, return, refund, repair or replacement right you may have under the CPA, ECTA or any other applicable law.
Where a statutory cooling-off right applies, you may exercise it within the period and subject to the conditions set by that law. Some goods, including personalised or made-to-specification goods, may be excluded from a statutory cooling-off right. We will explain the applicable process on request.
Approved refunds will be made to the original payment method where reasonably possible. We may require reasonable proof of purchase, photographs, return of the goods or collection of the goods before processing a return or remedy.
9. DEFECTIVE, UNSAFE OR INCORRECTLY SUPPLIED GOODS
Nothing in these Terms limits your rights under the CPA. In particular, goods must meet the standards required by section 55 of the CPA, including being reasonably suitable for their intended purpose, of good quality, in good working order and free of defects, taking account of the nature of the goods and any specific disclosure made to you.
If goods are defective, unsafe or not what you ordered, please notify us promptly at info@ge-skenk.co.za, with your order number and photographs where possible. Within six months after delivery, you may have the right under section 56 of the CPA to return goods that fail to meet the requirements of section 55 and to choose a repair, replacement or refund, subject to the CPA.
We will assess the issue fairly and handle it in line with the CPA. We will not require you to waive rights that the CPA gives you. Any product-liability right you may have under section 61 of the CPA is not excluded by these Terms.
10. THIRD-PARTY RESELLER CHANNELS
This webshop is the official direct store for Geskenk. While our branding and website URL are present on our delivered packaging, any orders placed via independent reseller networks, such as Bloomable, are legally contracts with that specific reseller. Geskenk is not liable for reseller billing, tracking, or platform service issues. Transactional disputes must be raised with the reseller, while physical product defects will be reviewed by Geskenk under Section 61 of the CPA.
This clause does not limit any non-excludable obligation that Geskenk may have under South African law, including the CPA.
11. CORPORATE, BESPOKE AND BRANDED ORDERS
For corporate, bespoke, branded or bulk orders, a written quotation, proposal, purchase order or service agreement may contain additional terms about artwork approval, lead times, minimum quantities, payment milestones, delivery and cancellation. Those agreed written terms apply in addition to these Terms. If there is a conflict, the specific written terms agreed for that order prevail to the extent permitted by law.
You warrant that any logo, artwork, text or other material you give us may lawfully be used by us to fulfil your order. You remain responsible for obtaining the necessary permissions.
12. YOUR PERSONAL INFORMATION AND POPIA
Geskenk processes personal information in accordance with POPIA. We collect only the information reasonably needed to operate the website, process and deliver orders, communicate with you, prevent fraud, meet our legal obligations and improve our services. This may include your name, contact details, delivery details, account information, order history, communications with us, technical website information and, where applicable, recipient details you provide.
We use your information only for a lawful and relevant purpose. We may share the minimum necessary information with trusted operators who help us process payments, host the website, deliver goods, prevent fraud or provide technical services. Those operators may process the information only for the authorised purpose and must apply appropriate safeguards.
We keep personal information only for as long as reasonably necessary for the purpose for which it was collected, or longer where we are required to retain it by law. We use reasonable technical and organisational measures to protect personal information, but no online system is completely risk-free.
Where required, we will obtain your consent before sending direct marketing. You may opt out of marketing at any time by using the unsubscribe option in the message or by contacting us at info@ge-skenk.co.za. You may also ask us to confirm what personal information we hold about you, request correction of inaccurate information, object to certain processing, or request deletion where the law permits. Contact us at the same address to exercise these rights or to raise a privacy concern.
Our website may use cookies and similar technologies for essential functionality, security, analytics and preferences. You can manage cookies through your browser settings. Third-party websites, embedded content and payment providers have their own privacy and cookie practices.
13. ACCEPTABLE USE AND INTELLECTUAL PROPERTY
All website content, including the Geskenk name, logo, photographs, text, product curation, designs and layout, is owned by or licensed to Geskenk and is protected by applicable intellectual-property law. You may use the website for lawful personal or business purchasing only.
You may not copy, reproduce, scrape, distribute, commercially exploit, interfere with or attempt to gain unauthorised access to the website or its content without our prior written consent. You may not use the website to submit false information, infringe another person’s rights, introduce malicious code or disrupt the website.
14. LIABILITY
We are responsible for providing the goods and services with reasonable care and skill and for meeting our legal obligations. We will not be liable for a delay or failure caused by circumstances beyond our reasonable control, such as a courier disruption, severe weather, infrastructure failure, civil disturbance or supplier interruption, provided that we take reasonable steps to reduce the effect on you.
To the maximum extent permitted by law, Geskenk is not liable for indirect or consequential loss, loss of profit, loss of business opportunity or loss arising from information you supplied incorrectly. This clause does not exclude or limit liability where it would be unlawful to do so, including liability or consumer rights arising under the CPA, liability for gross negligence or any right in relation to unsafe or defective goods.
15. COMPLAINTS AND DISPUTES
Please send any complaint to info@ge-skenk.co.za, with your order number and enough detail for us to investigate. We aim to acknowledge complaints within two business days and provide a substantive response within 14 business days, where reasonably possible.
If we cannot resolve a consumer complaint directly, you may use any remedy available to you under South African law, including referral to the National Consumer Commission, a provincial consumer protection authority, an accredited consumer ombud, the National Consumer Tribunal or a court with jurisdiction.
16. CHANGES TO THESE TERMS
We may amend these Terms from time to time. The updated version will be posted on this page with a revised “Last updated” date. The Terms in force when you submit an order will apply to that order, unless a change is required by law or we agree otherwise with you.
17. GENERAL
If any provision of these Terms is invalid or unenforceable, the remaining provisions will continue to apply. A failure by either party to enforce a provision immediately is not a waiver of that provision.
These Terms, together with the order confirmation and any specific written terms agreed for your order, form the agreement between you and Geskenk in relation to that order.
